By using our app, website, or related services (collectively, the “Service”), you agree to the following Terms of Service. Please read them carefully—they govern your use of the Service and protect our rights as creators.

If you do not agree to these Terms, do not use Ascended.

1. Eligibility

You must be at least 13 years old (or 16 in the EU) to use Ascended. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

To access certain features, you must create an account. You agree to:

• Provide accurate and current information

• Keep your login credentials secure

• Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms or our community guidelines.

3. Intellectual Property Ownership

All content and materials within Ascended—including but not limited to text, artwork, storylines, names, characters, lore, gameplay mechanics, icons, logos, user interface elements, and design—are the exclusive property of Level Up Fitness Inc. or its licensors.

You do not acquire ownership rights by using the Service. You are granted a limited, revocable, non-transferable, non-commercial license to access and use Ascended for personal use only.

You may not:

• Copy, distribute, or publicly display any portion of the Service

• Reverse engineer, decompile, or modify the Service or its source code

• Use our name, brand, or assets for commercial purposes without prior written consent

All rights not expressly granted are reserved by Level Up Fitness Inc.

4. User Content

If you post, upload, or share content (such as comments, profile names, screenshots, or feedback), you grant Level Up Fitness Inc. a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and adapt such content for operational, promotional, or product improvement purposes.

You are solely responsible for the content you share and agree it does not violate any laws or third-party rights.

5. Fitness Disclaimer

Ascended is designed for entertainment, motivation, and general wellness purposes only. It is not a substitute for medical advice.

By using the Service, you acknowledge that:

• You participate in workouts and activities at your own risk

• You are physically capable of performing exercises suggested by the app

• Level Up Fitness Inc. is not responsible for injuries, health issues, or damages arising from your use of the Service

Always consult a qualified healthcare professional before starting any fitness program.

6. Analytics & Third-Party Services

We use trusted third-party services—including Supabase, Amplitude, Meta Pixel (Facebook/Instagram), TikTok Pixel, Google Looker Studio, Mailchimp, and OneSignal—to provide analytics, communications, and technical functionality.

Your use of Ascended is also subject to their respective privacy practices, as described in our Privacy Policy.

7. Termination

We may suspend or terminate your access to Ascended at any time, with or without notice, for reasons including—but not limited to—violations of these Terms, fraudulent behavior, or misuse of the Service.

Upon termination, all licenses and rights granted to you will immediately cease.

8. Limitation of Liability

To the fullest extent permitted by law:

• Level Up Fitness Inc. and its affiliates shall not be liable for indirect, incidental, or consequential damages, including loss of data, revenue, or profits

• Our total liability for any claim related to the Service shall not exceed $100 USD

Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless Level Up Fitness Inc., its founders, officers, employees, contractors, and partners from any claims, damages, losses, or expenses arising from:

• Your use of the Service

• Your violation of these Terms

• Your infringement of any third-party rights

10. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware

11. Changes to These Terms

We may update these Terms from time to time. If material changes are made, we will notify users through the app or via email. Continued use of Ascended after updates constitutes acceptance of the revised Terms.
